Forbes Australia Club  

 1. Terms and Conditions   

(a) You are making application to enter into a transaction (the “Transaction”) with Success Publishing Pty Ltd (hereinafter referred to as ‘Forbes Australia’) to purchase a package entitling you to membership of the ‘Forbes Australia Club’, If your application is accepted, you will become entitled to the benefits (“Entitlements”) set out in section 3 below.   

(b) By submitting your application and making a payment, under the Transaction you confirm that you:   

(i) have read, understood, and agree to these terms and conditions;   

(ii) agree to the privacy policy of Forbes Australia – https://www.forbes.com.au/privacy-policy/ ; 

(iii) acknowledge and understand that for Forbes Australia to properly assess your application, it is incumbent upon you to provide Forbes Australia with full and accurate details of your individual finances or company finances (as the case may be) & job title, failing which your application may be rejected and you may not receive the benefits to which you may otherwise be entitled.   

(iv) agree that the advertised line up & agenda for each Forbes Australia Club experience is correct at release but is subject to change without notice and that you will not have any claim against Forbes Australia for refund of all or portion of the price of the Forbes Australia Club or any other claim whatsoever.  

2. Payment  

(a) You agree:  

(i) to pay Forbes Australia in full, when making your application to purchase a Forbes Australia Club package.  

(ii) until payment has been completed in full, you will not be entitled (nor able) to receive any of the entitlements comprising the Forbes Australia Club.  

(b) All pricing is in Australian Dollars and includes local taxes.  

3. Forbes Australia Club Entitlements   

Once your application to purchase the Forbes Australia Club package has been accepted, you will become entitled to: 
(a) An invitation to 4 Forbes Australia Club experiences (“Experience”) within a 12-month period from date of (final) payment. 

(b) Each Experience will include: 

(i) Networking opportunities with other Forbes Australia Club members 

(ii) Food & beverages 

(iii) A question & answer session with a high-net-worth successful businessman/businesswomen  

Please note, you must, at your expense, make your own accommodation and travel arrangements for any Experience. 

(c) A 12-month premium Forbes Australia subscription. 

5. Membership Entitlement  

(a) Membership is personal and non-transferable. 

(b) To maintain the standards of membership, a member may not allow any other person to access or exploit its membership.  To do so constitutes a breach justifying immediate termination of membership. 

(c) Membership is for a period of 12 calendar months (Membership Term) following the month in which an application for membership is accepted or the membership fee paid, whichever is the later.  

(d) Benefits are valid only during the Membership Term and will automatically expire thereafter. 

5. Requirements of Purchase  
(a) A name, contact number (including a valid email address) and relevant financial and employment details will be required to complete the Forbes Australia Club application process.  Such information will be treated as strictly confidential and will not be shared with any other person. 

(b) Only approved applicants of Forbes Australia Club will be granted access to the entitlements set out in section 3 above. 

6. Cancellation Rights  

(a) You will have 10 business days from the date of payment to be eligible for a refund. 

(b) Requests for a refund must be made in writing to club@forbes.com.au 

(c) Requests made after 10 business days or via alternative methods other than the email address listed in 5(b) will not be eligible for a refund. 

(d) Should you qualify for a refund, the amount will be refunded within 21 business days from cancellation.  

(e) Entitlements not used may not be swapped or exchanged for credit.  

(f) If you have used or accessed any of the Entitlements, Forbes Australia reserves the right to deny you a refund in respect of the utilised portion or deduct reasonable costs for the amount returned to you. 

(g) If a Forbes Australia Club experience is postponed for any reason, entitlements will apply to the rescheduled experience. You will have no other claim of any nature arising out of such postponement.  

(h) If a Forbes Australia Club experience is cancelled for any reason, you will be provided with an alternative experience. You will have no other claim of any nature arising out of such cancellation. 

7. Forbes Australia Club Resale  

(a) The re-advertisement or re-sale of Entitlements is strictly forbidden.   

(b) If any Entitlements are found to be re-advertised or for re-sale Forbes Australia reserves the right to cancel all Entitlements without refund and the bearer of the Forbes Australia Club package will not be provided with Entitlements.  

(c) Only Forbes Australia Club purchases made directly through Forbes Australia will be guaranteed access to or participation in an Entitlements.  

Scalping warning: The resale of Entitlements in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.  

8. Force Majeure  

(a) If a Forbes Australia Club experience has to be re-scheduled, postponed or cancelled as a result of an act of God, Government legislation, public health orders, an inevitable accident, power cut, fire, blackout, flood, COVID-19, pandemic, injury, death or any other calamity, or if by reason of strikes, or lockouts, or any other events beyond the direct control of either party, Forbes Australia reserves the right to postpone and reschedule the experience within 12 months of the postponed experience. 

(b) Forbes Australia reserves the right to alter the venue, speakers and amend the agenda due to circumstances outside of its control.   

(c) Forbes Australia will not be liable in any manner whatsoever for any cancellation or postponement of a Forbes Australia experience as a result of Force Majeure or a change of venue or amendment to the agenda arising out of this clause 7.    

9. Privacy and your security:  

(a) Forbes Australia will collect personal information including but not limited to name, contact details, email address, postal address and financial or employment details. This information (excluding financial information) will only be shared with approved partners to provide access to Forbes Australia Club and enhance your Forbes Australia Club experience.  

(b) You acknowledge and agree that Forbes Australia may disclose and use your personal information in accordance with the Forbes Australia privacy policy available at Forbes Australia –https://forbes.com.au/privacy-policy    

(c) By joining the Forbes Australia Club, you consent to:   

(i) your name, organisation and job title being published in delegate lists and shared with commercial partners in advance of, during and/or after the Forbes Australia Club for the purpose of networking and marketing; and  

(ii) the publication and/or use of your name, organisation, job title, image, voice, statement or otherwise, in the Forbes Australia Magazine or any other media (digital or print) for the purpose or reporting on or publicizing the Forbes Australia Club without any payment or compensation.   

(iii) Should you not wish to appear in any promotional or marketing materials you must notify us via club@forbes.com.au within 10 business days of making payment. 

10. Filming:  

(a) You acknowledge and agree that portions of the Forbes Australia Club may be recorded, and that Forbes Australia shall own any recordings that can be used at their discretion for promotional or marketing purposes.  

(b) You agree not to record any part of Forbes Australia Club. Failure to comply with this directive could lead to your participation in Forbes Australia Club being revoked with no refund or credit being provided.   

(c) You may not use recordings from Forbes Australia Club for commercial purposes without the prior written consent of Forbes Australia which may be withheld in our absolute discretion.  

(d) Without derogating from the above, materials distributed by Forbes Australia as part of Forbes Australia Club may not be distributed or re-produced.  

11. Forbes Club Information   

(a) All notices or other communications must be made to club@forbes.com.au. 

(b) Should you be unable to attend a Forbes Australia Club experience, you may defer one (but not more than one) experience by instead participating in any Forbes Australia Club that takes place during the   12-month period following the missed experience.  For avoidance of doubt, you may attend a replacement experience even if your membership of the Forbes Australia Club has terminated before the date of the replacement experience. 

(c) One invoice is generated per order and communication is solely with the buyer of the Forbes Australia Club package unless alternative contact details are provided by the buyer of the Forbes Australia Club package.  

(d) All attendees must act and behave in a respectful way to fellow attendees, staff, and speakers. Failure to do so may result in removal from the Forbes Australia Club.  

12. Disclosure:  

(a) Any views expressed by or the content of any presentation of any speaker or panelist at or in connection with the Forbes Australia Club does not represent (and must not be construed as) the views of Forbes Australia and we will not be liable for any loss, damage of emotional suffering caused by any such views or content.   

(b), you acknowledge that any financial views expressed are the views of the presenter and should not be acted upon unless and until you have received professional advice in relation thereto.  Any decision made by you because of anything heard, read or otherwise learnt by you at the Forbes Australia Club is an exercise of your own judgment and not attributable to Forbes Australia in any manner whatsoever.     

(d) Dress code is smart casual.  Any inappropriately dressed attendee may be refused access to the Forbes Australia Club 

13. General   

a) These Terms shall in respects be governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts in New South Wales to determine any matter or dispute which arises under these Terms.  

b) This agreement constitutes the entire agreement between the parties. Any prior arrangements, agreement, representations, or undertakings are superseded.
